1. GENERAL RULES AND DEFINITIONS
"Il Messaggiere" was first published 275 years ago on 14 August 1749 during the Napoleonic era as an Italian daily newspaper in Modena, located on the southern edge of the Italian Po Valley and a few kilometres from the foot of the Apennines. From the very beginning, "Il Messaggiere" was the official newspaper of the Duchy of Modena and Reggio.
As a conservative Italian business and financial newspaper, "Il Messaggiere" mainly reports on current political and economic topics from Italy and the Emilia-Romagna region as well as on current topics from around the world in the following languages: Italian, French, German, Spanish and English.
1.1 If you choose to use the "ILM" sites (the "Site"), the "ILM" pages and mobile applications, any features of this Site, including but not limited to RSS, APIs, software and other downloads (collectively, the "Services"), you agree to all the terms and conditions of these Terms of Use between you and "IL MESSAGGIERE" ("ILM", "we", "us" or "our").
The daily newspaper "IL MESSAGGIERE" refers in its daily publication to the Italian Constitution, in this case with reference to Article 21 and Law No. 47 of 8 October 1948. The Constitution of the Italian Republic expressly states that the press is not subject to authorisation or censorship (Article 21, paragraph 2) and that it cannot be confiscated by the authorities.
1.2 "IL MESSAGGIERE" may modify, add or remove portions of these Terms of Use at any time, effective immediately upon posting. It is your responsibility to review these Terms of Use before using the Website and by continuing to use the Website you agree to be bound by any changes.
1.3 "IL MESSAGGIERE" may change, suspend or discontinue any aspect of the Services at any time, including the availability of any feature, database or content of the Services. We may also impose limits on certain features and services or restrict your access to some or all of the Services without notice or liability.
2. CONTENT OF THE SERVICES
2.1 The content of the Services, including the Website, is for your personal, non-commercial use. All materials published on the Services (including but not limited to news articles, photographs, images, illustrations, audio and video clips, also known as "Content") are protected by copyright and are owned or controlled by "IL MESSAGGIERE" or the party credited as the provider of the Content. You must comply with any copyright notices, information or restrictions contained in the Content you access through the Services.
2.2 The Services and the Content of "IL MESSAGGIERE" are protected by Italy and international copyright laws. You may not modify, publish, transmit, participate in the transfer or sale, reproduce (except as provided in Section 2.3 of these Terms of Use), create new works, distribute, perform, display or in any way exploit the Content or the Services (including software), in whole or in part.
2.3 You may download or copy the Content and other downloadable items displayed on the Services for your personal use only, provided that you retain all copyright and other notices contained therein. Copying or storing any Content for other than personal use is expressly prohibited without the prior written consent of "THE MESSAGGIERE" Rights and Permissions Department or the copyright owner identified in the copyright notice contained in the Content.
2.4 The contents of the Services are the property of "IL MESSAGGIERE" or are subject to a licence. Certain Content is provided by AP (Associated Press), AFP (Agence France Presse) and Thomson Reuters, who shall not be liable for any delays, inaccuracies, errors or omissions in such Content or in the transmission or delivery of all or any part of such Content or for any damages arising therefrom.
3. USER-GENERATED CONTENT: SUBMISSIONS, INCLUDING COMMENTS, READER REVIEWS AND THE LIKE
3.1 You may not upload, distribute or otherwise publish any defamatory, obscene, pornographic, offensive or otherwise unlawful content on the Services.
Be courteous. As a reader, you agree not to threaten or insult other members, not to use defamatory language, and not to intentionally disrupt discussions with repetitive, unnecessary or "spam" messages. Use respectful language. As in any community, online conversations thrive only when our members feel welcome and safe. You agree not to use offensive or discriminatory language based on race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services. Discuss, but do not attack. In a community full of opinions and preferences, there will always be differences of opinion. "IL MESSAGGIERE" encourages active discussion and welcomes lively debate on the Services, but personal attacks are a direct violation of these Terms of Use and will result in immediate and permanent suspension of access to all or part of the Services.
3.2 The services of "IL MESSAGGIERE" may only be used for non-commercial purposes. You may not distribute or otherwise publish material containing solicitations, advertisements or offers of goods or services without the express permission of "IL MESSAGGIERE".
3.3 You acknowledge that any Contributions you make to the Services (i.e. User Generated Content, including but not limited to comments, forum posts, reviews, text, video, audio and photographs, and computer code and applications) (each a "Contribution") may be edited, deleted, altered, published, transmitted and displayed by "ILM" and you waive any rights you may have to alter the material in any way that is unacceptable to you. Submissions made to the Services may also be included in our RSS and API feeds and made available for republication in other formats.

You grant "IL MESSAGGIERE" a perpetual, non-exclusive, worldwide, royalty-free and sub-licensable licence to the Submissions, including but not limited to the right for "IL MESSAGGIERE" or its designee to use, copy, transmit, publish, distribute, publicly display, publicly perform, create derivative works, host, index, cache, tag, encode, use, transmit, publish excerpts, distribute, publicly display, publicly perform, create derivative works to host, index, cache, tag, encode, modify and adapt (including but not limited to the right to adapt to streaming, download, broadcast, mobile, digital, thumbnail, scanning or other technologies), in any form or medium now known or hereafter developed, for any User Materials posted by you on the Services or any other website owned by "ILM", including any materials posted on the Services through third parties.
3.5 You are solely responsible for the content of your Submission. "IL MESSAGGIERE" cannot and does not review all Submissions and is not responsible for their content. However, "ILM" reserves the right to remove, move or edit any Submission that "ILM" deems, in its sole discretion, to be offensive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.
3.6 By submitting a Contribution, you consent to its display and publication on the Website and the Services and its use for online and offline promotional purposes.
3.7 Persons involved in the production of a work reviewed on the Website or the ILM Services may not submit a Reader Review for that work or for competing works.
4. USE OF THE SERVICES
4.1 You must not access or use, or attempt to access or use, the Services to take any action that may harm us or any third party. You must not access any part of the Services that you are not authorised to access. You may not attempt to circumvent any usage or access restrictions or conditions or perform any "ILM" that would disable or impair the operation or appearance of the Services, including the display or performance of advertising. The display of advertising is a condition of access to the Services.
4.2 The Services contain links to other websites, resources and advertisers. As we are not responsible for the availability of such external resources or their content, you are responsible for raising any concerns you may have about any external link to such website.
THE SERVICES AND ANY DOWNLOADABLE SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
5. REGISTRATION AND SECURITY
5.1 As part of the registration or account creation process, you will create login credentials by choosing a password and providing an email address. The user must also provide us with certain registration details which must be accurate and up to date.
Each registration is only valid for one user. You are not authorised to share your registration details with others or to pass them on to others. We may block or suspend your access to the ILM Services if you share your login details. You are responsible for maintaining the confidentiality of your password and are under no obligation to disclose it to any representative or agent of "ILM". You may not (i) select or use another person's identifier with the intent to impersonate that person; (ii) use any identifier to which another person has rights without that person's permission; or (iii) use any identifier that we, in our sole discretion, deem objectionable. Failure to do so will constitute a breach of these Terms of Use and may result in the immediate suspension or cancellation of your account.
5.2 Please notify E-Mail: [email protected] of any known or suspected unauthorised use of your account or any breach of security, including loss, theft or unauthorised disclosure of your password or credit card information.
5.3 You must be at least 13 years of age to subscribe to all parts of the Services.
5.4 You are responsible for all use and activity of your account on the "ILM" Sites, including use of your account by third parties authorised by you to use your login credentials. Any fraudulent, abusive or otherwise illegal activity may, in our sole discretion, be grounds for termination of your account, and we may refer you to the appropriate law enforcement authorities.
6 COMMUNICATION BETWEEN ILM AND USER
6.1 If you indicate on the registration form that you wish to receive such information, we, our owners and authorised agents, authorise certain third party providers to send you information about products and services.
6.2 "ILM" reserves the right to send you emails to notify you of changes or additions to the Service.
6.3 "ILM" reserves the right to share information about your usage and demographics, provided that your personal identity is not revealed when sharing this information. Advertisers and/or licencees of our website may only collect and share your personal information if you give your consent. For more information, please read our Privacy Policy.
6.4 ILM" may contact you by email to ask you to participate in user surveys and to seek your views on current services or future products and services. This information will be used to improve our services and better understand our users and any information we receive from these surveys will not be disclosed to any third party, except in aggregate form.
7. SOFTWARE LICENCES
7.1 You have no rights to the copyrighted software and related documentation and any enhancements or modifications provided to you to access the Services (the "Software"). You may not sub-licence, assign or transfer the licences granted by ILM" and any attempt to do so is null and void. You may make one copy of the Software for archival purposes only. You may not copy, distribute, modify, reverse engineer or create derivative works of the Software.
8. DELETION
8.1 You may delete your account by sending us an email to the following address: [email protected]
Once you cancel, you will receive an automatic email confirming that your cancellation has been processed and your access will be suspended within 24 hours. Cancellation of paid digital products is subject to our Digital Product Cancellation and Refund Policy.
8.2 "ILM" may, in its sole discretion, terminate or suspend your access to all or part of the Services for any reason, including, but not limited to, breach or assignment of these Terms of Use.
9. MISCELLANEOUS
9.1 These Terms of Use are created, construed and enforced in accordance with the laws of the Republic of Italy.
Any action to enforce these Terms of Use must be brought in the courts of Rome (Republic of Italy).
9.2 Notwithstanding the foregoing, nothing in these Terms of Use shall prevail over the commitments made by "THE MESSAGGIERE" under its Privacy Policy.

9.4 You agree to notify "THE MESSAGGIERE" of any breach of the Terms of Use as soon as you become aware of it.
